CEO of Ripple, Brad Garlinghouse spoke about crypto regulation today and shared his views about what it would mean to Ripple if US regulators were to declare XRP as a security. Garlinghouse went on to state that if the SEC deems XRP a security, US citizens would require a broker-dealer license to trade the crypto. Moreover, this would also include the firm itself, since there are several companies that use Ripple’s ODL service to source capital and initiate payments using XRP. But according to the CEO, more than 90 percent of RippleNet customers are “out of the US” and further said:

We are solving the cross-border payment problem, which is more of a pain for smaller countries.

The CEO said in a podcast that he found it “very hard” to look at XRP as a security and stated:

I look at it as one member and Ripple’s an important member of the XRP community. It’s my very strong opinion that it’s very hard to look at XRP as a security…You know if XRP were deemed a security here in the United States that, you know, we have other G20 markets that have taken a different view. I’m not aware of any market globally that thinks that XRP is a security.

With regard to whether Ripple would ever move from the US, the CEO maintained Ripple was a “proud US company.” For a while now, Ripple has drawn much speculation after Garlinghouse revealed that he was considering moving Ripple’s headquarters to London, over the lack of clear regulations on cryptocurrencies in the US. Again, Garlinghouse claimed that the US regulatory framework was “out of sync” with approaches taken by other countries.

He even pointed out how the SEC gave Bitcoin and Ether a “housekeeping seal of approval” but remain undecided when it comes to XRP. However, the CEO called for a “level-playing field,” not only for XRP companies “to compete effectively,” but for other projects as well, and said:

I want crypto to do well.

Recently, Garlinghouse was all praise for Bitcoin and stated that BTC was a real store of value and “useful” as a hedge against inflation.

Meanwhile, with regard to why XRP was not part of payments giant PayPal’s offering, Garlinghouse believed this could be due to a lack of regulatory clarity on XRP

Bitcoin has undergone a strong rally over the past few weeks, rallying from the $11,000 range to $18,700 as of this article’s writing. A comparison between BTC’s current rally and the rally that Tesla saw in late 2019 suggests that in the year ahead, BTC could be primed to see exponential growth.

Although this conclusion can be drawn from a fractal, analysts say that similarly bullish sentiment can be drawn from fundamentals and technicals. Bitcoin is about to close its highest monthly candle in history, higher than the December 2017 candle of $14,000, while the fundamentals of this space improve at a rapid clip.

Bitcoin Set to Erupt Higher, Tesla Comparison Shows

Tesla has undergone a stellar rally since the lows it reached last summer. In fact, in the past year, the car company has actually outperformed Bitcoin.

According to a fractal comparison of Tesla’s rally over the past year (offset by 52 weeks) and Bitcoin’s current price action, BTC is on the verge of a strong move higher.

Alex Krüger, an economist closely tracking the cryptocurrency space, recently made the comparison between the two assets, referencing the chart seen below:

“Tesla started its bull run on October 2019. A month later, by November 21st, it was 10% from its prior all time highs. Just like bitcoin now. If in the next 12 months Bitcoin were to perform like Tesla did, $BTC would hit $125K… There are many similarities between Tesla & Bitcoin. Both are cult assets. Both attract haters like bees to honey. Both had a wide multi-year consolidation range. Both had a vertical bull-run kickstarted by positive developments. And both have strong long-term macro tailwinds.”

Tesla started its bull run on October 2019. A month later, by November 21st, it was 10% from its prior all time highs.

Just like bitcoin now.

Krüger said a number of days ago that Bitcoin could pull a Tesla-like rally in the months ahead.

Fundamentals Predict Strong Upside Ahead

The fundamentals predict that further gains are on the horizon for Bitcoin holders.

Raoul Pal, CEO of Real Vision, recently said on the fundamental performance of BTC;

“Bitcoin’s performance is SO dominant and SO all-encompassing that it is going to suck in every single asset narrative dry and spit it out. Never before in my career have I see a trade so dominant that holding any other assets makes almost no sense. The macro, flows, technology, demography and societal strains have all converged to this moment in time and the definite answer from markets is – #bitcoin.”

Pal is of the belief that the cryptocurrency may hit $1,000,000 this cycle due to fundamental trends:

Commodities trader and analyst Peter Brandt said on Twitter that XRP would have been deemed a security if the US Securities and Exchange Commission (SEC) regulators completely understood the workings of cryptocurrencies. Brandt published his XRP stance in response to a comment by one Twitter user going by the name of Rexiby crypto, who claimed that Ripple owned “almost half of the total circulating coins.”

According to Brandt, XRP was a “classic case of a market being manipulated by a bag-holder.”

XRP would have been declared as a security if the SEC understood cryptos. This is a classic case of a market being manipulated by a bag-holder.

Recently, on 5 November, Ripple published its quarterly XRP Markets Report to “voluntarily provide transparency” on the company’s views on the state of the XRP market. In it, and as indicated in the Q2 2020 XRP Markets Report as well, Ripple said it was actively buying – “and may continue to purchase” – XRP “to support healthy markets.”

According to the report, in Q3 2020, Ripple bought close to $46 million worth of XRP. Moreover, back in 2018, it had revealed that Ripple owned 60 billion XRP, of which 55 billion was locked up in escrow accounts.

But with regard to regulators, to date, the SEC has shut down several cryptocurrency projects for selling unregistered securities however the financial regulator remains undecided in the case of Ripple and XRP. In fact, US Department of Justice published a cryptocurrency “enforcement framework” after which the CEO of Ripple, Brad Garlinghouse stated that the 70-page report was “contradictory” and did not offer regulatory clarity. Garlinghouse had even argued that US lawmakers were making the crypto economy a “guessing game:”

On the other hand, former CFTC chairman Chris Giancarlo had once remarked that XRP was not a security at all. However, attorneys for a company called Bitcoin Manipulation Abatement LLC once filed a lawsuit accusing Ripple and Garlinghouse of misleading investors and selling XRP as unregistered security in violation of federal law in the US. Meanwhile, a federal district court in the US had even decided to allow a lawsuit accusing XRP for being an unregistered security. At that time, Ripple’s motion to dismiss the lawsuit against it was only partially granted.

While the crypto community decides whether Bitcoin (BTC) was born — or merely conceived — 12 years ago, the fact is that Oct. 31, 2008, remains one of the most notable dates in humanity’s modern history. Exactly 12 years ago, Satoshi Nakamoto published what some have described as “a new bible” — Bitcoin’s white paper. Designed as a brand new “purely peer-to-peer version of electronic cash,” many see the creation of Bitcoin as a response to a global financial crisis.

Although Bitcoin has recently become more appealing than both Jesus and sex, at least among Reddit users, let’s not forget that it’s only Bitcoin’s 12th anniversary and that many great achievements and challenges still lie ahead, though for this real-world saga, we can only hope to know how this story will end and who will emerge as the victor.

It is a question that many in the crypto community must have asked themselves at least once. The news of Wladimir van der Laan taking a temporary hiatus, prompted us to explore what some might consider to be an improbable, yet highly impactful situation.

A Bitcoin Core developer that is also a maintainer of the project’s GitHub account (i.e., someone who can “merge code into the master branch”) is a rare commodity. To put this in perspective, if a Bitcoin Core developer is a black belt, then someone like van der Laan is a third-degree black belt.

To set the record straight we interviewed the well-known sensei and master of the Blockstream dojo, Adam Back. He said that neither Laan’s departure, nor the disappearance of all the maintainers in the event of a potential catastrophe, would present a challenge to Bitcoin (BTC):

“It’s no problem either way technically because even if all maintainers had a plane crash or very unlucky IT failure. A new Github can be created.”

Back also opined that most in the crypto community do not truly understand the role of Core developers in the ecosystem and tend to overestimate their importance. In his view, the changes that Bitcoin Core developers can introduce are bound by being backward compatible and should not change the key properties of the protocol like finality, censorship resistance, or rate of inflation. He also noted that changes should preserve or improve privacy. Back believes if the developers tried to introduce ideals outside of this paradigm, they would be rejected by the ecosystem:

“So I do not think a given implementation of bitcoin’s developers can change things outside of that area, as the economic ecosystem would reject it, use a different implementation.”

Back is also against any sort of on-chain governance as he believes that this would lead to the “centralized lobbying groups” taking control of Bitcoin, noting that this is a problem inherent to proof-of-stake protocols. We parried that with the current system, some believe that organizations like Back’s Blockstream, Lightning Labs, Chaincode Labs and others that support Bitcoin Core developers, have a disproportional amount of influence in the ecosystem. Back replied that Blockstream purposefully does not take a position on Bitcoin proposals. At the same time, Core developers under the company’s employ can quit Blockstream if they believe they are being pressured to do something bad for Bitcoin and the company would have to pay their salary for another year.

We asked the Hashcash inventor why, if the decision-making process within the Bitcoin ecosystem is so harmonious, do debates sometimes become so heated? It is well known that some have even lead to schisms, like in the case of the block size debate. In his view, this happened because some participants were trying to force their way to a change:

“I consider that to largely be because some companies and mining pools tried to forcibly change the change process to benefit their businesses financially.”
